CAREFULLY  READ THE FOLLOWING TERMS AND CONDITIONS OF USE BEFORE USING THIS WEBSITE.

 

All users of this site agree that access to and use of this website are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Typographical Errors

In the event that a Marsh Fastener product is mistakenly listed at an incorrect price, Marsh Fasteners reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Marsh Fasteners reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Marsh Fasteners will issue a credit to your credit card account in the amount of the incorrect price.

Listing Photos

Listing photos are generic for the fastener type listed. They are not to scale and only used as a visual aid for basic specifications (IE: Head Style, Drive, etc.). Photos are not to scale and sized to fit the website. Please refer to the description for fastener details. Product Packaging

Marsh Fasteners used several different product packaging method. These include boxed, bagged and bulk. Your order will be processed based on best method or previously arranged packaging agreement.

Product Samples

Samples are available for purchase. We sell certain items by the piece, so you can purchase pieces as samples. Contact our sales department with additional questions concerning samples and our sample policy.

 

Fulfillment Expectations

  • Most orders placed to Marsh Fasteners are processed and shipped within 1 or 2 business days. Credit cards will be charged once the product is processed for shipping. A valid credit card is best for prompt order process and shipping.
  • Orders received after 2:00pm EST will enter the fulfillment process the following business day.
  • Special orders are treated on an order basis due to the nature of the specific product
    • Special orders that require manufacturing (In house or Marsh Fastener manufacturer), Lead time is offered at time of quotation
    • Special order (custom packaging, kitting, etc) Varies depending on type and quantity required. Lead time is offered at time of quotation

Next Day Air Shipping and Second Day Shipping

  • Orders placed with a Shipping Method of "Next Day Air" or "Second Day"  will be shipped and cannot be altered or canceled after the order has been placed due to priority processing procedures.
  • Expedited Shipping Methods may be charged additional costs which may need to be collected after purchase, based on product dimensions and quantities.
  • Customer is responsible for any additional shipping costs associated with a premium shipping method, including Next Day Air, Second Day, Overnight and Express shipments from UPS or any other shipping provider

Shipping Method Changes

Due to the nature of fasteners, we reserve the right to ship best way. This includes changing the shipping method, carrier and box quantities

  • Marsh Fasteners reserves the right to change and/or correct any shipping method that is selected for any reason, with the additional cost being the responsibility of the customers

LTL/ Truck Shipping Fees

Due to LTL/ Freight Shipping requirements, some locations may require special services to deliver orders, such as tail gate/lift gate service. If these services are required in the customer’s area, at extra fees, the customer will be required to pay these fees.

International Shipping Charges

International Shipping Charges paid at the time of purchase are estimated charges. Marsh Fasteners may go back to the customer at the time of shipping to collect any additional shipping charges that were not collected at the time of checkout.

  • Marsh Fasteners is not responsible for damage to international packages and we won’t replace shipments that have been damaged or lost that have been shipped internationally.
  • When shipping to a Freight Forwarder, once the order is in their possession, delivery arrangements are now between the customer and the forwarder.

 

Address Undeliverable

If the Shipping Address provided by the buyer proves to be an undeliverable or insufficient address, and no attempt at contact has been made by the buyer prior to the return to sender, the purchase will be refunded when the package returns to Marsh Fasteners and subject to the 20% restocking fee.

Insufficient Address

In the event that the Shipping Address provided by the buyer proves to be an incorrect or insufficient address, and the carrier has to make a special delivery attempt, the additional carrier charges will be billed to the customers. This includes wrong zip codes, suite and apartment numbers and other details that need to be correct at the carrier so delivery can be completed.

 

Refunds without Return

Once an order is marked as delivered by the carrier, delivery inquiries from the customer must be made with the carrier. Please see our Return Policy more details regarding returns and exchanges. Once the order is marked as delivered by the shipping carrier, Marsh Fasteners is no longer responsible for package delivery and refunds cannot be issued. The chain of custody is now between the customers and the shipping carrier.

Order Errors

Once an order has shipped, Marsh Fasteners is unable to cancel, change or alter the order in any manner.

  •  All orders returned due to errors made by the customer that have not been successful communicated to Marsh Fasteners prior to shipment, will be treated as a Voluntary Return.

Purchase Orders

  • If submitting a purchase order the buyer voids all signature requirements and accepts the following terms and conditions:
  • If paying by purchase order, terms are Net 30 days from the date of the invoice.
  •  All invoices for Purchase Orders will be sent exclusively by Mail, email, or fax.
  • Paying by purchase order does not entitle the customer to a discount unless approved by management.
  • Management reserves all rights, including updating/changing Purchase Order Terms as well as order cancellation, or rejection.

Credit Card Chargebacks

Customers are advised not to issue chargebacks with their credit card company or bank. Contact Marsh Fasteners to address any questions regarding their order. If a chargeback is opened and found to be in the favor of Marsh Fasteners, all fees related to the chargeback are the responsibility of the credit card holder. Fees and/or charges will be billed by Marsh Fasteners to the customer and/or credit card holder, and are due within 21 days of the invoice date. npaid fees and/or charges will be sent to Collections.

Interest and Collection Fees:

If an order has been processed, shipped and delivered to the designated delivery location as per the Terms and Conditions of sale of Marsh Fasteners and full payment of an invoice(s) or balance due of invoice(s) remain unpaid, the collection action will commenced against the persons or company(ies) identified under the "Bill To" and "Send To" section of the invoice(s) (hereinafter referred to as the "Buyers") for any unpaid invoice(s) or balance(s) of unpaid invoice(s).

  • Collection action will begin against the Buyers after the Buyers have been sent a Notice for Demand of Payment by email and/or as required by law.
  • The Buyers will also be responsible for full payment of any and all interest accrued for the unpaid invoice(s) and/or balance(s) of the unpaid invoice(s), and for all collection and reasonable legal fees, including attorney fees, incurred by Marsh Fasteners, a d/b/a of Metric Connection Incorporated, to collect payment of such unpaid invoice(s) or balance(s) of unpaid invoice(s).

Notice

Marsh Fasteners may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Marsh Fasteners. Once an order has been placed and processed it cannot be altered in any way including additions and subtractions.

Warranty Disclaimer

This site and the products and materials on this site are provided "as is" and without warranties of any kind, whether express or implied.

Marsh Fasteners does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components

Marsh Fasteners does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise.

To the fullest extent permissible pursuant to applicable law, Marsh Fasteners disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Limitation of Liability

Proper fastener connection design takes in to account where and how fasteners are used. Allowance for special characteristics in materials, differences in materials, differences in types of materials being joined, unique or unusual environmental service or installation conditions and the safety factors required by anticipating normal or short term loading conditions must be considered. Due to possible differences in specifications, applications, and interpretation of results, customers must make their own evaluation of the products to determine the suitability for products sold by Marsh Fasteners to determine the suitability of these products for intended use.

Marsh Fasteners shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Marsh Fasteners has been advised of the possibility of such damages.

Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
